aerMist LLC LIMITED WARRANTY

 

 

Limited Warranty

aerMist LLC warrants its products to the original purchaser to be free from defects in materials and workmanship and agrees to repair or replace, at aerMist LLC's sole discretion, any defective product free of charge for a period of the following time:

One Year Warranty:

All high pressure misting pumps and remote controllers.

 

 

6 Month Warranty:

All connector fittings, filter housings, tubing, and tools.

 

90 Day Warranty:

Misting nozzles.

 

Repair or replacement pursuant to this limited warranty shall not renew or extend the original warranty period. Any repaired or replaced product shall be warranted for the remaining original warranty period only. This warranty extends to the original purchaser only and commences on the date of the original purchase.

Any part of this product manufactured or supplied by aerMist LLC, and found in the reasonable judgement of aerMist LLC, to be defective in material or workmanship will be repaired or replaced without charge for parts and labor by aerMist LLC or its Authorized Service Center. The product, including any defective part, must be returned to aerMist LLC within the warranty period. The expense of delivering the product to aerMist LLC for warranty work and the expense of returning it back to the purchaser after repair or replacement shall be paid by the purchaser. aerMist LLC's responsibility in respect to claims is limited to making the required repairs or replacements and no claim of breach of warranty shall be cause for cancellation or rescission of the contract of sale of any aerMist LLC brand product. All warranty work must be performed by aerMist LLC or its Authorized Service Center.

This warranty does not cover any product that has been subject to misuse, neglect, negligence, or accident, or that has been operated in any way contrary to the operating instructions as specified in the user's manual. This warranty does not apply to any damage to the product that is the result of improper installation or maintenance or to any product that has been altered or modified so as to adversely affect the product's operation, performance or durability or that has been altered or modified as to change its intended use. The warranty does not extend to failures caused by normal wear and tear, freight damage, damage from freezing, fire, natural disaster, use of any liquids other than filtered potable water, improper installation, or damage due to misapplication and/or misuse.

This warranty does not apply to the installation of any products whether by the consumer or a third-party installer, whether referred to you by aerMist LLC or not. In addition, this warranty does not cover: consumables such as filter cartridges, o-rings, or regular wear and tear items.

aerMist LLC reserves the right to change or improve the design of its products without assuming any obligation to modify any product previously manufactured.

 

ALL IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE STATED WARRANTY PERIOD. ACCORDINGLY, ANY SUCH IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE, ARE DISCLAIMED IN THEIR ENTIERETY AFTER THE EXPIRATION OF THE STATED ONE-YEAR, SIX-MONTH, OR NINETY-DAY EXPRESS WARRANTY PERIOD. AERMIST LLC'S OBLIGATION UNDER THIS WARRANTY IS STRICTLY AND EXCLUSIVELY LIMITED TO THE REPAIR OR REPLACEMENT OF DEFECTIVE PARTS. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. AERMIST LLC ASSUMES NO RESPONSIBILITY FOR INCIDENTAL, CEONSEQUENTIAL OR OTHER DAMAGES INCLUDING, BUT NOT LIMITED TO EXPENSE OF RETURNING THE PRODUCT TO AERMIST LLC AND EXPENSE OF DELIVERING IT BACK TO THE PURCHASER, LOSS OR DAMAGE TO PERSONAL PROPERTY, LOSS OF REVENUE, LOSS OF USE OF THE PRODUCT, LOSS OF TIME, OR INCONVENIENCE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
